Terms and Conditions
1. INTRODUCTION
www.pursuefitness.com (the “Website”) is owned and operated by Pursue Fitness Ltd (“Pursue Fitness”, “we”, “us” or “our”). Pursue Fitness Ltd is a company incorporated and registered in England and Wales with company number 08687090 and VAT registration number 177767155.
These Terms and Conditions apply to all purchases made via this Website and our mobile application. By placing an order, you agree to be bound by these Terms.
These Terms form a legally binding contract between you and Pursue Fitness once we accept your order.
2. ELIGIBILITY
To place an order, you must be at least 18 years old or have the consent and supervision of a parent or guardian. You must be authorised to use the payment method provided.
3. PLACING AN ORDER
Orders are placed through our Website or mobile application. Please ensure that all information provided at checkout, including delivery address and contact details, is accurate.
You will receive an order confirmation email acknowledging receipt of your order. This email does not constitute acceptance of your order.
A contract between you and us is formed only when your order has been dispatched.
We reserve the right to refuse or cancel any order before dispatch where:
- Products are unavailable;
- Payment authorisation fails;
- There is an obvious pricing or description error;
- A promotional code is used improperly;
- We suspect fraudulent, abusive or commercial re-sale activity;
- Shipping or regulatory restrictions apply.
If we cancel your order before dispatch, any payment taken will be refunded in full.
4. ORDER CANCELLATIONS
We begin processing orders immediately after they are placed. While you may request cancellation, we cannot guarantee cancellation once processing has begun.
If your order has already been dispatched, it cannot be cancelled and must instead be returned in accordance with Section 8 below.
5. OUR PRODUCTS
We supply fitness apparel and accessories for private and personal use only.
Minor differences in colour, texture or finish may occur due to photography, screen settings or manufacturing variations. Such differences do not constitute defects.
We are under a legal duty to supply products that are in conformity with this contract.
Please follow all care instructions provided. We are not responsible for damage caused by failure to follow care instructions.
6. PRICE, TAXES AND PAYMENT
Prices may be displayed in multiple currencies depending on your location. The final price payable will be shown at checkout.
For customers in the United Kingdom, European Union and United States, applicable taxes and import duties are included in the price shown at checkout.
For customers in Australia, orders under a total value of AUD $1000 will not be subject to customs or import fees at delivery. Orders exceeding this threshold may be subject to customs or import charges determined by Australian authorities.
For other destinations, customs duties, taxes or import charges may apply unless clearly stated otherwise at checkout.
We accept payment via the methods displayed at checkout. Payment is taken at the point of dispatch, although your bank may show a pending transaction earlier.
If the rate of applicable tax changes between your order date and dispatch date, we may adjust the tax applied where required by law.
If a pricing error is obvious and unmistakable, we reserve the right to cancel the order and refund any amounts paid.
7. SHIPPING, CUSTOMS AND IMPORT FEES
All orders are dispatched from the United Kingdom. We ship worldwide unless otherwise stated at checkout.
United Kingdom
Orders delivered within the United Kingdom are domestic and will not incur any customs or import fees.
European Union
Orders delivered to EU member states will not be subject to customs or import fees at delivery. Applicable duties and taxes are included in the price paid at checkout.
United States
Orders delivered to the United States will not be subject to customs or import fees at delivery. Applicable duties and taxes are included in the price paid at checkout.
Australia
Orders delivered to Australia under a total order value of AUD $1000 will not be subject to customs or import fees at delivery. Orders exceeding this threshold may be subject to customs or import charges determined by Australian authorities.
Rest of World
For destinations outside the regions listed above, customs duties, taxes or import charges may apply depending on local regulations. These charges are determined by local customs authorities and are the responsibility of the customer unless clearly stated otherwise at checkout.
If customs charges are refused and a parcel is returned to us, we may deduct original shipping costs, return shipping costs and any customs charges incurred from your refund.
Delivery timeframes provided at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by events outside our reasonable control, including customs processing.
8. RETURNS, EXCHANGES AND REFUNDS

If you are located in the United Kingdom or European Union, you have a statutory right to cancel within 14 days of receiving your goods. This right is exercised by notifying us and returning the goods in accordance with our returns procedure.
We offer 30 days from receipt for returns for refund, exchange or store credit.
Items must be returned unworn, unused, in original packaging, with all tags attached and free from marks, odours or damage.
The following items are non-returnable for hygiene reasons:
- Socks;
- Underwear;
- Headwear;
- Towels;
- Water Bottles;
- Swimwear.
Refunds will be processed within 10 days of receiving returned goods. Payment providers may take additional time to make funds available.
Gift cards are non-refundable.
We reserve the right to refuse returns that do not comply with our returns policy.
9. PROMOTIONS AND DISCOUNT CODES
Promotional codes are valid only for the period specified and may be subject to additional conditions communicated at the time of issue.
Only one promotional code may be used per order unless stated otherwise.
Codes cannot be exchanged for cash and are non-transferable.
We reserve the right to withdraw or amend promotions where reasonably necessary.
10. LIABILITY
We supply products for private use only. We are not liable for business, commercial or re-sale losses.
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.
Subject to this, our total liability arising from any order shall not exceed the total amount paid for the products concerned.
11. PERSONAL INFORMATION
We will use your personal information only in accordance with our Privacy Policy.
12. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
Where you are a consumer, this does not affect any mandatory rights you may have under the laws of your country of residence.
13. OTHER IMPORTANT TERMS
We may transfer our rights and obligations under these Terms to another organisation.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force.
If we delay in enforcing these Terms, this does not prevent us from enforcing them later.
Amendments
We may update these Terms from time to time. The version in force at the time of your order will apply.
